The learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month.
The petitioner seeks anticipatory bail in connection with Avtarnagar P.S. Case No. 56 of 2021, registered for the offence under Sections 420 of the Indian Penal Code. The main submissions advanced by learned counsel for the petitioner are that in actual there is a dispute between the petitioner and his brother who fabricated a false story in collusion with informant, the alleged cheque was issued on 16.10.2020 which was deposited by the informant on
Patna High Court CR. MISC. No.59986 of 2021(2) dt.06-06-2022 2/2 20.10.2020 but after more than three months period the present case was lodged by the informant. Further submission is that the petitioner is a handicapped person and not in position to move freely.
Heard both the sides and perused the FIR. The main allegation against the petitioner is that he took Rs. 2,25,000/- from the informant on the pretext of providing a job to his son in Food Corporation of India. When he failed to provide the job, the informant demanded the said money. On such demand, the informant was given a blank cheque by the brother of the petitioner as submitted and the same was dishonoured by the bank concerned. The nature of allegation is serious and the same relates to cheating punishable under Section 420 of the Indian Penal Code.
Considering the above facts, this application for anticipatory bail is dismissed.
