Mr. Manoj Kumar Singh, Advocate ====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 12-07-2022 Heard learned counsel for the petitioners, learned counsel for the Informant and learned APP for the State and perused the case diary.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 420, 406 and 376/34 of the Indian Penal Code.

It is a case of committing rape by co-accused Abhishek Kumar and further allegation against these petitioners is that they cheated Rs.1000/- and gold chain from the informant.

It is submitted by learned counsel for the petitioners that the petitioners have falsely been implicated in this case. He

No. 60463 of 2021(4) dt.12-07-2022 2/2 further submits that specific allegation of rape is against coaccused Abhishek Kumar and not these petitioners and no amount was recovered as well as gold chain from the possession of the petitioners and petitioners have not been arrested at the spot.

Learned APP appearing for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid submissions, let the petitioners above named in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Khagaria in connection with Khagaria P.S. Case No. 13 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Sunil Kumar Panwar, J) Brajesh Kumar/- U T
