Petitioner seeks anticipatory bail in connection with Samastipur Town P.S. Case No. 86 of 2019 registered under Sections 376,511,328/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the alleged occurrence is said to have taken place on 19.04.2019 in presence of the friends of the informant including one Ravi Trivedi who happens to be the brother of the friend of the informant and there is no allegation of committing rape against the petitioner. There is allegation of forcibly entering into her room and compelling her to take wine.

It has been further submitted that similarly situated co-accused has already been granted anticipatory bail by a

Patna High Court CR. MISC. No.49119 of 2019(2) dt.16-11-2019 2/2 coordinate Bench of this Court vide order dated 15.10.2019 passed in Cr. Misc. No. 47127 of 2019 in which nature of allegation and involvement of petitioner has been considered in detail. Petitioner has no criminal antecedent. Considering the facts and circumstances of the case, prayer of Anticipatory bail is allowed and petitioner named above in the event of arrest or surrender before the court below within four weeks from today, Petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Samastipur, in connection with Samastipur Town P.S. Case No. 86 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
