BAJANTHRI ORAL ORDER 16-12-2022 The matter is heard through video conferencing. Petitioner seeks regular bail in Pandarak P.S. Case No. 44 of 2022, registered for the offence punishable under Section 379 of the Indian Penal Code.

Learned counsel for the petitioner submitted that other co-accused persons have already been granted bail in Cr. Misc. No. 50001 of 2022.

Having regard to the nature of offence read with the fact that other similarly situated co-accused persons have been released on bail by this Court, petitioner is also entitled to identical relief on par with other co-accused. Petitioner is directed to be released on bail on furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief

Patna High Court CR. MISC. No.49571 of 2022(2) dt.16-12-2022 2/2 Judicial Magistrate 1st , Barh, Patna in connection with Pandarak P.S. Case No. 44 of 2022, subject to following conditions: (i) The petitioner shall co-operate in investigation and in conclusion of the trial.

(ii) He shall remain present on each and every date of trial till conclusion of trial.

(iii) He shall not try to tamper with the evidence or intimidate the witness to delay the conclusion of trial. (iv) In the event of default of two consecutive dates without any valid reasons, his bail bonds is liable to be cancelled.

(v) The Court below shall verify the criminal antecedent of the petitioner and in the case, at any stage, it is found that petitioner had concealed his criminal antecedent, the court below or investigating authority shall take immediate step for cancelling bail bond of the petitioner. However, acceptance of bail bonds, in terms of the aforementioned order shall not be delayed for this purpose or in the name of verification. (P. B. Bajanthri, J) rakhi U
