2. The instant application for anticipatory bail has been filed by the petitioners apprehending their arrest in a case instituted for the offence punishable under Sections 191(1), 191(2), 190, 115(2), 109(1), 117(2), 74, 324(2), 303(2), 351(2), 352 of the Bharatiya Nyaya Sanhita.

3. The prosecution case, in brief, is that, as per the allegations made in the FIR, while the informant

2/4 was present at his shop, the petitioners, along with the other co-accused persons, allegedly arrived there armed with lathis, iron rods, sticks, and other weapons. It is alleged that they began abusing the informant, restrained him from visiting his land and demanded extortion money of Rs. 5,00,000/- (Rupees Five Lakhs). When the informant raised protest, the accused persons allegedly damaged the articles kept in his shop and vandalized his motorcycle. It is further alleged that informant was dragged outside from the shop, where coaccused Ajay Paswan assaulted him on the head with an iron rod. On hearing the commotion, the informant's wife and other family members came to rescue him, but they too were allegedly assaulted. The accused persons are also alleged to have snatched the mangalsutra and other valuables from the possession of the informant's wife.

4. Learned counsel appearing on behalf of the petitioners has submitted that petitioners are innocent

3/4 and have committed no offence. They have falsely been implicated in the instant case in the background of personal enmity and village politics. There is no specific allegation against the petitioners rather the specific allegation of assaulting the informant by means of iron rod is levelled against co-accused Ajay Paswan. Present case is counter case of Mohanpur P.S. Case No. 430 of 2025. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent.

5. Learned A.P.P. for the State has vehemently opposed the prayer of bail.

6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioners on bail. The petitioners are directed to surrender in the Court below within a period of four weeks from the date of receipt/production of this order and in the event of their arrest or surrender in connection with Mohanpur P.S. Case no. 444 of 2025 they will be enlarged on bail

4/4 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate- II, Sherghati, Gayaji (Bihar) subject to the conditions as laid down under section 482 of Bharatiya Nagrik Suraksha Sanhita (BNSS).
