JUSTICE ARUN KUMAR ORAL ORDER 30-03-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody since 23.12.2017, seeks bail in connection with Sitamarhi Mahila P.S.Case No. 21 of 2017 registered under Sections 363, 365, 376/34 and 120B of the Indian penal Code and 4, 5 and 6 of the Prevention of Immoral Traffic Act.
Allegation in brief is that petitioner's husband had purchased the informant at Rs. 2 lacs for indulging her in flesh trade and she was recovered from the house of the petitioner. Learned counsel for the petitioner submits that informant alleged that four persons used to force her for indulging in flesh trade and Manjoor Khalifa and Ramjan Khalifa who are said to have assaulted the prosecutrix for indulging in flesh trade, they have been granted anticipatory bail by a co-ordinate Bench of this
Patna High Court Cr.Misc. No.18311 of 2018 (2) dt.30-03-2018 2/2 Court vide order dated 20.02.2018 passed in Cr. Misc. No. 7314 of 2018 and by this Court vide order dated 21.02.2018 passed in Cr. Misc. No. 2164 of 2018, but there is no such allegation against this petitioner.
Having considered the aforesaid facts and circumstances, the petitioner, namely , Geero Jarina Khatoon @ Geero Khatoon, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Sitamarhi in connection with Sitamarhi Mahila P.S. Case No. 21 of 2017 with condition that one of the bailor must be her close family member. Petitioner shall remain physically present on each and every date during trial and in case of failure on two consecutive dates without any reasonable cause, her bail bond shall be liable to be cancelled.
