Heard both parties.
The petitioner seeks bail in Raghopur P.S. Case No. 04 of 2015 corresponding to Sessions Trial No. 185 of 2018, registered for the offence punishable under Section 302/34 of the Indian Penal Code and section 27 of the Arms Act. Earlier prayer for bail of the petitioner was rejected vide order dated 22.12.2017 with an observation to conclude the trial within a period of nine months.
It is submitted on behalf of the petitioner that during trial PW 2 brother of the deceased and PW 5 father of the deceased (informant) have been examined and they have not supported the prosecution case. In their deposition which is
Patna High Court CR. MISC. No.8125 of 2021(2) dt.21-05-2021 2/2 annexed as Annexure-3, both of them have stated that at the time of occurrence they were not present at the place of occurrence. Petitioner is in custody since 30.11.2016. Considering the period of custody and the deposition of PW 2 and PW 5 (informant), the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge Ist-cum-Special Judge, Hajipur, Vaishali in connection with Raghopur P.S. Case No. 04 of 2015 corresponding to Sessions Trial No. 185 of 2018 subject to following conditions:- (i) The petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the Court and in the event of failure on two consecutive dates without sufficient reasons, his bail bond shall be liable to be cancelled by the court below.
(ii) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner. (Prabhat Kumar Singh, J) vinita/- U T
