2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 399 and 402 of the Indian Penal Code and 25 (1-b)/a/26/35 of Arms Act.
3. As per the prosecution case , informant and others on secret information that some miscreants have assembled to commit some crime, conducted a raid two persons were apprehended with arm who disclosed the name of the petitioner.
4. Learned counsel for the petitioner submits that he has falsely been implicated in this case on the confessional statement of co-accused persons apprehended on the spot. No incriminating articles have been recovered from the possession
Patna High Court CR. MISC. No.52971 of 2024(2) dt.22-08-2024 2/2 of this petitioner. Except confessional statement there is no other material available on the record to show the complicity of the petitioner in the alleged occurrence . Petitioner claims clean antecedent.
5 . Learned counsel for the State opposes the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM East Champaran Motihari in connection with Pipra P.S. case No. 355 of 2023 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
