Petitioner apprehends arrest in a case registered for the offence punishable under Section 30a of the Bihar Prohibition and Excise Act.

Prosecution's case, in brief, is that 355.500 liters foreign liquor was recovered from the room of the Samudayk Bhawan which is alleged to have been kept by the petitioner and other accused persons.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner and he is nowhere

Patna High Court CR. MISC. No.60934 of 2021(2) dt.24-06-2022 2/2 concerned with the alleged recovery or business of illegal liquor as no substantive evidence has been collected during course of investigation to suggest that the petitioner was engaged in the trade of illegal liquor. Petitioner has got no criminal antecedent. Considering the facts of the case, in the event of arrest/surrender within six weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge cum Special Judge, Excise Act, Saran at Chapra in Dariyapur Police Station Case No. 217/2021 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
