The petitioners seek bail in connection with Mehndiganj P.S. Case No. 98 of 2020, registered for the offence punishable under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

As per prosecution case, husband of informant had

Patna High Court CR. MISC. No.49575 of 2022(2) dt.09-12-2022 2/2 gone to temple for personal work and after some time informant got the information that her husband was lying in injured condition and sustained gunshot injury in his back and doctor declared him dead.

Learned counsel for the petitioners submits that petitioners are not named in the F.I.R. and their names have been disclosed by the co-accused in the confessional statement having no evidencial value. The petitioners are lady and are in custody since 14.06.2022. Petitioners bear no criminal antecedent.

The learned APP for the State opposes the prayer for bail of the petitioner.

Considering the facts and circumstances of the case, the Court is inclined to grant bail to them. Let the petitioners above, named, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Patna City in connection with Mehandiganj P.S.
