2. The petitioner is seeking regular bail in connection with Hussainganj P.S. Case No. 55 of 2024 for the offences punishable under Sections 399, 402, 414 of the IPC and Section 25(1-b)a26/35 of the Arms Act and Section 8(c)/21(b) of the NDPS Act.

3. As per allegation, on the tip off, the informant along with police personnel conducted a raid near Nahar bridge. Seeing the police party, some accused persons tried to flee away but with the aid of police party, three accused persons including the petitioner were apprehended. On search, 17 puriya of smack like substance, mobile phone and one loaded country-made

Patna High Court CR. MISC. No.52528 of 2024(2) dt.01-08-2024 2/2 pistol as well as live cartridge were recovered from the possession of two apprehended accused persons.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He has further submitted that nothing was recovered from the possession of the petitioner. The petitioner is a person of clean antecedent and is under custody since 28.02.2024.

5. On the other hand, the learned APP for the State has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances as well as the clean antecedent, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned Session Judge, Siwan in connection with Hussainganj P.S. Case No. 55 of 2024, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
