JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 24-03-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 364A/34 of the Indian Penal Code.

As per the prosecution case, this petitioner kidnapped the son of informant and demanded ransom of Rs. Two lakhs. It is further alleged that this petitioner gave threatening that if the ransom amount is not paid his son would be killed. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case due to village politics. Petitioner claims clean antecedent and is in custody since 07.04.2021 and investigation in this case is complete.

Patna High Court CR. MISC. No.60332 of 2021(3) dt.24-03-2022 2/2 Learned counsel appearing for the State opposes the prayer for bail and submits that victim in his statement recorded u/s 164 of the Cr. P. C. fully supported the prosecution case of his abduction and vividly described the whole incident. Considering the nature of accusation, gravity of the offence and the statement of victim recorded u/s 164 of the Cr. P. C., I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.

However, since the petitioner is in custody since 07.04.2021, the trial court is directed to conclude the trial as early as possible.
