Let the petitioner surrender and pray for regular bail before ACJM, Dalsingsarai in connection with Dalsingsarai P.S.Case No.310 of 2014, when the Court below shall admit the petitioner to bail by accepting the bond provisionally. The learned court below shall issue a notice to the lady fixing a date for her appearance. The notice shall be directed to be served both by the court processes as also through the concerned police station.
The court below shall talk to the parties in its Chambers and try to untie the knots in the relationship and shall make efforts to restore the relationship. The Court believes that the court below may not succeed on a single day and it may be required to adjourn the hearing due reconciliatory efforts. The court below shall not
Patna High Court Cr.Misc. No.36135 of 2014 (2) dt.20-02-2015 hesitate in adjourning the hearing but shall make meaningful efforts. If the Court finds that the lady has taken a very difficult position by placing certain unreasonable conditions, in that case, the court below shall confirm the bond. If the court finds that reverse was the case on behalf of the petitioner, then his bond shall be cancelled and he shall be remanded to custody. In case of success of the reconciliatory efforts by the court below, the court below shall still observe the relationship and allow it to cement within as many a months as six in the maximum whereafter it shall try to dispose of the case on compromise.
With the above observations and directions, this petition stands disposed of.
