The petitioner seeks bail in Laheriasarai (Beta O.P.) P.S. Case No. 87 of 2018 registered under Sections 341, 323, 324, 307, 448, 354B, 379 and 504/34 of the Indian Penal Code. Petitioner along with other accused persons are said to have assaulted the informant, his brother and misbehaved with the womenfolk of the house of the informant and petitioner also assaulted his neighbour Nilam Devi on his hand by means of knife on protest made by the informant about taking intoxicant substance by them in his rented room.

It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. He has no

Patna High Court Cr.Misc. No.31465 of 2018 (2) dt.24-05-2018 2/2 concern with the aforesaid occurrence. He has not made any assault. He has been falsely implicated in this case due to animosity. No one had sustained any injury in the alleged assault. Other allegations are general and omnibus in nature. He has no criminal antecedent. He has been languishing in custody since 27.02.2018.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga in connection with Laheriasarai P.S. Case No. 87 of 2018.
