====================================================== CORAM: HONOURABLE MR. JUSTICE ALOK KUMAR ORAL ORDER 29-07-2026 Heard learned counsel for the petitioner and the learned APP for the State.

2. The petitioner apprehends his arrest in connection with Bikramganj (Excise) P.S. Case No. 126 of 2026, instituted for offences under Sections 30(a) and 30(d) of the Bihar Prohibition and Excise Amendment Act, 2022.

3. The Prosecution case, in short, is that upon receiving confidential information regarding the manufacturing or handling of liquor near the Kav River, Police personnel reached the specified location. They observed several individuals attempting to flee upon seeing the Police personnel. Out of which one Ritesh Kumar, was apprehended by the police, who disclosed the names of other accomplices, including the name of the petitioner, Prince Kumar. Upon search, 46 litres of illicit country-made liquor were recovered.

4. Learned counsel for the petitioner submitted that the petitioner has been falsely implicated in the present case. The name of the petitioner transpired in this case solely on the basis of confessional statement of co-accused Ritesh Kumar. It was further submitted that the petitioner has no criminal antecedent.

5. Learned A.P.P. for the State vehemently opposed the prayer for the grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances of the case, and taking into account the fact that petitioner has no criminal antecedent and that his name has surfaced in this case merely on the confessional statement of co-accused, let the petitioner, in the event of arrest/surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 15,000/- (Rupees Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Bikramganj (Excise) P.S. Case No. 126 of 2026, subject to the conditions laid down under Section 482(2) of the Bharatiya Nagarika Suraksha Sanhita, 2023. (Alok Kumar, J) manish/- U T
