2. The petitioner seeks regular bail in connection with Choutham P.S. Case No. 02 of 2023, registered for the offence punishable under Section 420 of the Indian Penal Code and Section FCO-7, FCO-4(2) Rules of Fertilizer Control Act, 1985.

3. As per prosecution case, 50 Kgs. of Fertilizer has been recovered from the possession of the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and have falsely been implicated in this case. Petitioner has no criminal antecedent and he is in judicial custody since 27.05.2023.

5. Learned APP has vehemently opposed the prayer for bail.

6. Considering the nature of allegation and also period of custody, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Khagaria in connection with Choutham P.S. Case No. 02/2023.
