JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State The statement of victim has been recorded under section 164 of the Cr.P.C in which she has stated that she was never kidnapped by any person rather she had gone to the village of his maternal grand father along with petitioner. Although, police has submitted charge sheet under section 376 and other minor sections of the Indian Penal Code but taking note of the statement of victim recorded under section 164 of the Cr.P.C, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhepura in connection with Srinagar P.S.Case No. 124 of 2013.
