Petitioner seeks regular bail in connection with Chandi P.S. Case No. 489 of 2020 registered for the offence under Section 341 / 323 /307 / 504 / 509 / 354 / 335 / 379 / 34 of the I.P.C.

The allegation as per the First Information Report is that the petitioner assaulted the informant by means of iron "khanti" on her head with an intention to kill. Learned counsel for the petitioner submits that both the parties are agnates inasmuch the petitioner is the uncle of the informant and there is dispute between them with regard to the drainage. Learned counsel next submits that from perusal of the injury report of the informant at page no. - 15 of the petition it would be evident that all the injuries caused to the informant are simple in nature, the petitioner is in custody since 19.10.2020

Patna High Court CR. MISC. No.6258 of 2021(2) dt.13-04-2021 2/2 and charge sheet has already been submitted in the matter. Having regard to the submissions made by learned counsel for the parties and taking into consideration the materials available on record, the fact that both the parties are closely related, dispute between them is with regard to construction of drainage, petitioner is in custody since 19.10.2020 and injuries caused to the informant are simple in nature, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Hilsa, Nalanda in connection with Chandi P.S. Case No. 489 of 2020.

It is made clear that at the time of furnishing bail bond all the parties shall follow the guidelines regarding social distancing.
