JUSTICE ARUN KUMAR ORAL ORDER 27-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 12.1.2018, seeks bail in Madhubani Mahila PS Case No. 39 of 2017 registered under Sections 376 and 506 of the IPC.

The allegation in brief is that the informant, whose husband is missing for last several years, with whom the petitioner developed intimacy and established sexual relationship, when she became pregnant and asked for marriage he denied.

Learned Counsel for the petitioner submits that the prosecutrix is a married lady, she herself stated that she developed immerse relationship with the petitioner so it was consensual relationship with a woman.

Having considered the said facts and circumstances, the petitioner, namely, Kisun Sahni @ Kisun Deo Sahni @ Gonga Sahni is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of SDJM Madhubani in connection with Madhubani Mahila PS Case No. 39 of 2017.
