This application for anticipatory bail arises out of Jadia P.S. Case No. 51 of 2019, disclosing the offence under Sections 341, 342, 323, 332, 353, 354, 188, 504, 506/34 of the Indian Penal Code.

Allegedly, the police noticing an occurrence that nearly five persons were assaulting a woman after disrobing her, they had interceded whereafter the said persons and other 10-15 persons came there and they indulged in scuffle with the police party also.

No.48614 of 2019(2) dt.05-08-2019 2/2 Learned counsel appearing on behalf of the petitioners has submitted that the informant, who is a police constable, has though referred to local people, who are said to have named these petitioners who had participated in occurrence, identity of said local people has not been disclosed. Considering the above circumstance and the fact that the petitioner had no criminal antecedent, this application is allowed. Let the petitioners, above-named, in the event of their arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each, to the satisfaction of the learned ACJM-V, Supaul in Jadia P.S. Case No.

51 of 2019, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioners shall present themselves before the Police/ Court, as the case may be, as and when required and in the event of failure on their part to appear before the court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
