The petitioner apprehends his arrest in connection with Sanhaula P.S. Case No. 84 of 2012 for the offences punishable under Sections 323, 341, 324, 307, 379 and 34 of Indian Penal Code.

Although it is admitted by the learned counsel for the petitioner while fairly inviting the attention of the Court to the order present at Annexure-1 submits that the matter having been compromised between the parties hence the second attempt. The order present at Annexure-1 was passed on the earlier attempt made by this petitioner along with some others to seek anticipatory bail bearing Cr.Misc.No.35449 of 2013 but he chose to withdraw the application to surrender and seek regular bail and

Patna High Court Cr.Misc. No.5194 of 2016 (2) dt.31-03-2016 2/2 whereupon the application was permitted to be withdrawn with the liberty so prayed.

In view of the order earlier passed by this Court in Cr.Misc.No.35449 of 2013 on the liberty sought by the petitioner, he cannot turn around to make a second attempt for the same purpose and this application is accordingly disposed of. Bibhash/- (Jyoti Saran, J) U T
