07-05-2018 Heard Sri Ranjan Kumar, learned counsel for the petitioner and Mr. Md. Ansarul Haque, learned Addl. Public Prosecutor.

The sole petitioner, who is in custody in Kotwali (Purabsarai) P.S. Case No. 320 of 2017 registered for offence under Section 379 of the Indian Penal Code, has prayed for grant of bail, primarily; on the ground of parity. Learned counsel for the petitioner submits that one of the co-accused, having similar accusation, has been granted bail by order dated 01-05-2018 passed in Cr. Misc. No. 25861 of 2018. He further submits that the petitioner was earlier made accused in Motihari P.S. Case No. 145 of 2017 and Begusarai (Town) P.S. Case No. 537 of 2017 and when he was granted bail in the said cases, subsequently, the petitioner was remanded in

Patna High Court Cr.Misc. No.27792 of 2018(2) dt.07-05-2018 2/2 the present case without any material.

Be that as it may, considering the fact that one of the co-accused in similar circumstance has been granted bail as well as nature of accusation, there is no reason to refuse the same relief to the petitioner.

Let the petitioner namely Rajnish Kumar be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Munger in connection with Kotwali (Purabsarai) P.S. Case No. 320 of 2017.
