This application in so far as the petitioner No.2, Guddu Kumar @ Ritesh Kumar is concerned, is thus dismissed as not pressed.

Heard learned counsel for the parties.

The petitioner No.1 apprehends his arrest in connection with Vishnupad P.S. Case No.119 of 2015 for the offences punishable under Section 379 of Indian Penal Code.

Patna High Court Cr.Misc. No.5187 of 2016 (2) dt.31-03-2016 2/2 Learned counsel for the petitioner with reference to the complaint present at Annexure-1 submits that it is merely based on suspicion.

Having heard learned counsel for the parties and considering the nature of allegation present, let the petitioner No.1 namely, Mukesh Kumar in the event of his arrest/surrender within four weeks from today, be released on bail upon furnishing bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya in connection with Vishnupad P.S. Case No. 119 of 2015 subject to the conditions stipulated under Section 438(2) of the Code of Criminal Procedure.
