JUSTICE ARUN KUMAR ORAL ORDER 15-05-2018 Heard learned Counsel for the petitioner and the State as also the learned Counsel appearing on behalf of the informant. Petitioner, already in custody since 16.3.2018, seeks bail in Sahajitpur PS Case No. 102 of 2016 registered under Sections 341, 323, 324, 307, 504 and 34 of the IPC.

The allegation in brief is that in a barat some scuffle took place, Sonu Kumar is said to have stabbed on the chest of the informant and the petitioner is said to have stabbed him in the stomach.

Learned Counsel for the petitioner seeks bail on he ground of parity as another co-accused Sonu Kumar was granted bail by a coordinate Bench of this Court vide Cr. Misc. No. 28118 of 2018 and further submits that there is no allegation of repetition of blow, the injured was treated firstly at Siwan hospital but no injury report was issued by the hospital as an application under RTI was filed for obtaining the same no injury report was made available as no such injury report exists, moreover petitioner has no criminal antecedent and is in custody since 16.3.2018.

Whereas learned Counsel appearing on behalf of the informant opposes the prayer for bail and submits that the injured was referred to Patna and was treated in a private hospital.

No.30146 of 2018 (2) dt.15-05-2018 Having considered the aforesaid facts and circumstances, as the case of the petitioner stands similar to that of Sonu Kumar so the petitioner, namely, Raman Verman @ Raman @ Raman Kuer @ Raman Verma is also directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM VIIIth, Saran at Chapra in connection with Sahajitpur PS Case No. 102 of 2016.
