In compliance of the order dated 21.03.2022, a counter affidavit duly sworn by the Superintendent of Police, Buxar has been filed and the case diary has also been received. After perusing the case diary and considering the submissions made by the learned counsel for the petitioner as recorded in order dated 21.03.2022 it manifest that the place of occurrence was at the house of the petitioner and not at the house of informant as alleged.

Learned A.P.P. for the State also does not dispute the said fact after perusing the case diary and submits that the place of occurrence is at the house of the petitioner. Considering the submissions made by the learned
