Smt. Nirmala Kumari ====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 03-05-2018 Heard Sri Purushotam Sharma, learned counsel for the petitioner and Smt. Nirmala Kumari, learned Additional Public Prosecutor.

The petitioner, who is husband of Ward Member and accused in connection with Mali P.S. Case No. 89 of 2017 registered for the offences under Sections 420, 467 & 468 of the Indian Penal Code, 1860 has prayed for grant of bail. Learned counsel for the petitioner by way of referring to the F.I.R. submits that it is peculiar case that informant had filed a written report to the Officer -In- Charge of Police Station in which it was alleged that an inquiry was conducted by the Block Development Officer on the same day i.e. on 17.11.2017 and it was alleged as if petitioner by way of committing fraud

Patna High Court Cr.Misc. No.26577 of 2018(2) dt.03-05-2018 2/2 had withdrawn amount allocated in the name of other beneficiaries including the informant. Learned counsel for the petitioner tried to persuade the Court that in such situation it was difficult for the petitioner to withdraw money from the 'Account' of other beneficiaries and petitioner has falsely been implicated due to village politics.

Besides hearing, I have perused the materials available on record particularly the F.I.R. and after going through the same, I am of the opinion that it is not a case for grant of bail.

The petition stands dismissed.
