JUSTICE MUNGESHWAR SAHOO ORAL ORDER 15-12-2015 Heard learned Senior counsel, Mr. Agarwal appearing for the petitioner and learned A.P.P. for the State. The petitioner, namely, Dharmendra Kumar, is in custody in Mohania P.S. Case No. 385 of 2015 under Sections 269, 270, 276 and 420 of the Indian Penal Code and Section 27(b)(II) 27(d), 28A of Drug and Cosmetic Act and also Section 30(I)(II) of Bihar Clinical Registration and Regulation Act.

The allegation against this petitioner is that his licence to keep drugs has already been expired and he is an Ayurvedic Doctor, but he is prescribing Homeopathic drugs also. The petitioner is in custody since 30.09.2015 and chargesheet has already been submitted and the petitioner is practicing as Ayurvedic Doctor.

Considering the above fact and circumstances, I direct the

Patna High Court Cr.Misc. No.55598 of 2015 (02) dt.15-12-2015 petitioner, above named, to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand rupees) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabhua in connection with Mohania P.S. Case No. 385 of 2015.
