The petitioner is languishing in custody for the offence punishable under Section 376 of the Indian Penal Code. Allegation against the petitioner is that he was in physical relation with the informant pretending that the petitioner would marry with the informant. Petitioner is in custody since 29.10.2017.

Considering the entire facts aforesaid, let the petitioner, above named, be released on bail after framing of the charge or on completion of four months of custody from the date of receipt of this order on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like

Patna High Court Cr.Misc. No.25423 of 2018 (2) dt.27-04-2018 P2/ amount each to the satisfaction of the learned Court-below where the case is pending in connection with Aurai P.S. Case No.170 of 2017, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
