2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 406, 420, 467, 468 , 471 and 34 of the Indian Penal Code .
3. As per the prosecution case , it is alleged that all the accused persons including this petitioner established a private bank in which the complainant and the witnesses were employed on commission basis and they deposited nearly an amount of Rs. 20 lakhs of various customers, but the payment of the acount-holders was not made despite assurance given by the petitioner and other co-accused persons.
4. Learned counsel for the petitioner submits that he has falsely been implicated in this case . From bare perusal of
Patna High Court CR. MISC. No.51898 of 2024(2) dt.21-08-2024 2/3 F.I.R., it transpires that it were co-accused Satyadev Yadav and Rajan Yadav who played active role in establishment of the alleged bank and collection of money and so far as this petitioner is concerned, he has simply made accused because he is one of the member of Board of Director. He further submits that for the same occurrence one complaint petition vide Complaint Case No. 92 of 2022 has been filed by one Sanjeev Kumar Gupta in which petitioner was also made accused and in the same case co-accused Satyadev Yadav and Rajan Yadav were main accused with specific accusation of committing the alleged occurrence who have already granted bail by coordinate Bench of this Court vide order dated 03.07.2023 passed in Cr. Misc. No. 58259 of 2022 .
5. Learned counsel for the State opposes the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate Bagaha West Champaran in connection with Bagaha P.S. case No. 679 of 2023 , subject
Patna High Court CR. MISC. No.51898 of 2024(2) dt.21-08-2024 3/3 to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
