JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 10-02-2022 Heard learned counsel for the petitioner and the State. The petitioner seeks regular bail in registered for the offences punishable under sections 25(1-B)a, 26 and 35 of the Arms Act and sections 20 and 22 of the NDPS Act. As per the prosecution case, one country made pistol and one kilogram Charas were recovered from the possession of the petitioner.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner. Petitioner is in custody since 27.6.2021.

Learned counsel for the State opposes the prayer for

Patna High Court CR. MISC. No.59962 of 2021(2) dt.10-02-2022 2/2 bail and submits that huge quantity of narcotic substance has been recovered from the possession of the petitioner. Considering the nature of accusation and the quantity of recovery, prayer for bail of the petitioner is refused. (Prabhat Kumar Singh, J) shashi/- U T
