The sole petitioner, who is in custody since 21.12.2017 in Kanti P.S. Case No.551 of 2017 registered for the offence under Sections 399, 400, 402, 413 and 414 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act, has prayed for grant of bail Learned counsel for the petitioner, by way of referring to the statement made in paragraph-3 of the petition, submits that the petitioner was having clean antecedent , however after being arrested in the present case, he has been made accused in another case also. He further submits that on false accusation of
Patna High Court Cr.Misc. No.27092 of 2018(2) dt.04-05-2018 2/2 recovery of one loaded country made pistol and a life cartridge, the petitioner was arrested along with other accused. Learned Addl. Public Prosecutor has vehemently opposed the prayer for bail.
However, considering the nature of accusation, period of custody as well as prior to lodging of the present case, the petitioner was having clean antecedent, let the petitioner, namely, Ajay Kumar be released on bail on furnishing bail bond of Rs.10,000/- ( ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate West Muzaffarpur in connection with Kanti P.S. Case No.551 of 2017.
