The petitioner is accused in connection with Mairwa P.S. Case No. 139 of 2015 registered under Section 120(B)of the Indian Penal Code and Section 25(1-b)a, 26 and 35 of the Arms Act.
The accusation is that the police was informed through Mobile No 9135831352 thrice about keeping of arms and ammunitions in the house of Yogendra Kanu but on verification the said information was wrong. Thereafter, petitioner and others informed to the police about keeping one country made pistol and four live cartridges by Yogendra Kanu in his house. Patna High Court Cr.Misc. No.56403 of 2015 (2) dt.16-12-2015 live cartridges but the petitioner and others started to flee away, which clearly indicates that they had planted the recovered arms in the house of Yogendra Kanu.
Learned counsel for the petitioner submits that the mobile number as detailed in the F.I.R. was not belonging to the petitioner, in fact, Yogendra Kanu got managed to implicate the name of petitioner and two others due to dirty village politics. It is further submitted that petitioner has no criminal antecedent and is in custody since 05.10.2015.
Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan, in connection with Mairwa P.S. Case No. 139 of 2015. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
