===================================== CORAM: HONOURABLE MR. JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 14-03-2016 Heard learned senior counsel for the petitioners, learned Additional Public Prosecutor for the State and learned counsel for the Informant.

This application, for grant of anticipatory bail, arises out of Jehanabad P.S. Case No.400 of 2015, disclosing offences under Sections 420 and 406 read with Section 120(B) of the Indian Penal Code.

Patna High Court Cr.Misc. No.6117 of 2016 (3) dt.14-03-2016 2/3 The two petitioners are father and son respectively. Petitioner No.1 is an ex-army man. The allegation against the petitioners is that on false assurance given to the informant, for ensuring his employment in Steel Authority of India Limited, they cheated him of a sum of Rs.3,00,000/-.

Learned senior counsel, appearing on behalf of the petitioners, submits that it is true that the petitioners had taken a family loan from the informant to the tune of Rs.98,000/-, which they subsequently returned to him. Learned counsel, appearing on behalf of the informant, on the other hand, has opposed the prayer for anticipatory bail and has submitted that it has come in course of investigation that amounts were deposited in the accounts of the petitioners, on several dates, to the tune of Rs.3,00,000/-.

Considering, however, the facts and circumstances, this application is allowed. Let the petitioners, abovenamed, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad, in connection with

Patna High Court Cr.Misc. No.6117 of 2016 (3) dt.14-03-2016 3/3 Jehanabad P.S. Case No.400 of 2015, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners, abovenamed, shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
