ANJANA MISHRA ORAL ORDER 13-04-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with Complaint Case No. 40(C)/14 registered for the offences punishable under Sections 354, 354(A), 504, 506, and 488 of the Indian Penal Code and Section 3(x)(1)(iii)(xi) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989. Learned counsel for the petitioner submits that the entire occurrence is a figment of imagination of the complainant and admittedly, the allegation is that the petitioner came in a drunken state, to the house of the complainant misbehaved with her, took her caste name while she was watching television in the rented house.

Considering the aforementioned submission as also the fact that the occurrence did not take place in public place rather in the

No.37294 of 2014 (2) dt.13-04-2015 rented house of the informant, let the petitioner, in the event of his arrest / surrender within a period of two weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned S.D.J.M., Masaurhi, Patna in connection with complaint Case No. 40(C)/14, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
