The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 366A/34 of the Indian Penal Code.

The accusation is of abducting the minor daughter of the informant by the petitioner and one unknown person.

It is submitted by learned counsel for the petitioner that in 164 Cr.P.C. the victim has got her age recorded as 17 years when the court has assessed as such where she has stated that she was abducted by the petitioner on motorcycle but she has not alleged any misbehaviour, hence, it was consent elopement.

Patna High Court Cr.Misc. No.56643 of 2015 (2) dt.14-12-2015 2/2 Let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Tribeniganj P.S. Case No. 193 of 2015 pending in the court of learned Judicial Magistrate, Ist Class, Supaul.
