Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 307, 504/34 of the Indian Penal Code.
The prosecution case is of making assault with farsha by co-accused Laxman Singh and petitioners by lathi to the husband of the informant. When informant and her daughter came to rescue, the accused persons also assaulted them.
It is submitted by the learned counsel for the petitioners that the injury of the informant, her husband and daughter has been found to be simple in nature. Though, incised injury has been caused to the husband of the
Patna High Court Cr.Misc. No.6716 of 2016 (2) dt.15-02-2016 informant, which is alleged to have been caused by co-accused Laxman Singh. Statement has been made in para-3 of the petition that petitioners have no criminal antecedent. It is further submitted that the occurrence took place in the background of grazing of crop by the animals of the informant's side.
Considering the nature of accusation and genesis of the occurrence, it is a case for consideration for prayer for regular bail, let the learned court below consider the prayer for regular bail of the petitioners, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Marhowrah (Gaura O.P.) P.S. Case No. 443 of 2015, pending in the court of learned Chief Judicial Magistrate, Saran at Chapra.
With the above observation this application is disposed of.
