JUSTICE JYOTI SARAN ORAL ORDER 11-02-2015 Heard Mr. Brajesh Kumar Singh, learned counsel appearing on behalf of the petitioner and learned counsel for the State.
The petitioner apprehends his arrest in connection with Naugachia P.S. Case No.69 of 2014 for the offences punishable under sections 147, 148, 149, 341, 323, 324, 307 and 504 of the Indian Penal Code.
Learned counsel for the petitioner straightaway with reference to the FIR has submitted that the only allegation against the petitioner is of assaulting the informant on the right foot. Learned counsel has again referred to the injury report placed at Annexure-2 to submit that except swelling on the right leg and that also on the thigh portion there is no injury on the foot and that the case in question is a counter case to the FIR
Patna High Court Cr.Misc. No.36013 of 2014 (2) dt.11-02-2015 arising from Naugachia P.S. Case No.68 of 2014 in which the petitioner was also assaulted and whose injury report is placed at Annexure-4.
Having heard learned counsel for the parties and taking note of the circumstances existing, let the petitioner, Surendra Das in the event of his arrest or surrender within four weeks from today be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Naugachia, District- Bhagalpur in connection with Naugachia P.S. Case No.69 of 2014 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
