The petitioners apprehend their arrest in Chand P.S. case No. 43 of 2018 under Section 307 and other minor Sections of the Indian Penal Code.

The informant, Dharmendra Sonkar, alleged that on 17.02.2018 the petitioners and others came and began to abuse the informant on account of quarrel between children of two families. It is further alleged that on the order of Munnan Sonkar, petitioner No.1, Punwasi Sonkar, petitioner No.2, assaulted the informant with Garasa on his head.

The learned counsel for the petitioners submits that the occurrence is said to have taken place on 17.02.2018 but the informant made his fard bayan on 22.02.2018. Prior to institution of the present case Iliya P.S. case No. 12 of 2018 was registered on 17.02.2018 from the side of petitioners in which informant and others were apprehended by the police and thereafter after five

Patna High Court Cr.Misc. No.25848 of 2018 (2) dt.03-05-2018 2/2 days of the occurrence the informant lodged this case. It is further submitted that on perusal of the injury report, it appears that no injury was found on the head of informant.

Considering the facts aforesaid and the nature of allegation made against the petitioners, the petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Kaimur at Bhabhua in connection with Chand P.S. case No. 43 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
