JUSTICE SATYAVRAT VERMA ORAL ORDER 25-11-2021 This case was taken out of turn on mentioning made by the learned counsel for the petitioner on the ground that daughter of this petitioner is getting married. Accordingly, a report was called for from the Superintendent of Police, Saran that as to whether the daughter of the petitioner is getting married or not.

The Superintendent of Police, Saran has submitted his report vide Letter No. 410 dated 22.11.2021 annexing the report of the S.H.O. Parsa Police Station wherein it has been recorded that daughter of the petitioner is getting married on 07.12.2021. Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Parsa P.S. Case No. 308 of 2021 instituted for the offences

Patna High Court CR. MISC. No.60305 of 2021(3) dt.25-11-2021 2/3 under Sections 30, 30(a), 33, 38 and 41 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 13.08.2021, charge-sheet has been submitted in the case and is a person with clean antecedent. Learned counsel for the petitioner submits that from bare perusal of the allegation as alleged in the F.I.R. it would manifest that 1923.48 litres of liquor is alleged to have been recovered from a school of which the wife of the petitioner is alleged to be the Headmistress and it is alleged that petitioner keeps the keys of the school.

Learned counsel for the petitioner submits that since wife of the petitioner is Headmistress of the school as such he came to be falsely implicated in this case.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody since 13.08.2021, charge-sheet has been submitted in the case and the petitioner is a person with clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned 2nd
