JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The present occurrence is said to have taken place in the year 2009 but admittedly, petitioner is not named in the first information report and his name surfaced in course of investigation in confessional statement of co-accused as well as some witnesses. Petitioner was made accused in Deo P.S. Case No.42 of 2014 besides the present one.

Learned counsel for the petitioner submits that coaccused persons, in whose confessional statement the name of this petitioner surfaced, have already been granted privilege of bail. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, namely,

Patna High Court Cr.Misc. No.58021 of 2015 (2) dt.04-01-2016 2/2 Ganesh Kumar be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Deo P.S.
