JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. According to prosecution case itself, two persons managed to escape from the place of occurrence but petitioner was caught and it is alleged that the vehicle in question was being driven by the petitioner.

The contention on behalf of the petitioner is that petitioner is a driver and as a matter of fact, the seized liquor belonged to those persons who fled away from there. Petitioner does not have any criminal antecedent.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with

Patna High Court Cr.Misc. No.56672 of 2015 (2) dt.15-12-2015 2/2 two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Jamhour P.S. Case No. 86 of 2015.
