Petitioner seeks bail in a case registered for the offences punishable under Sections 302 and 120B of the Indian Penal Code.

Tuntun Yadav, the son of the informant died in his house. During investigation, suspicion was raised that the petitioner and others might have committed murder by throttling him. Though, in the FIR, it is specifically stated that the deceased was in the habit of consuming Heroin and was a dealer of Heroin (narcotic).

Submission is that co-accused Bhanu Yadav @ Nand Kishore Yadav has already been allowed bail by a Coordinate Bench of this Court vide order dated 15.03.2018

Patna High Court Cr.Misc. No.23570 of 2018 (2) dt.24-04-2018 2/2 passed in Cr. Misc. No. 15052 of 2018 (Annexure-2). Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sessions Trial No. 44 of 2018 arising out of Mohania Police Station Case No. 574 of 2016, subject to the condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
