====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 29-07-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with Complaint Case No. C2-398 of 2019 for the offenses under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that petitioner has no criminal antecedent. In the instant case total 177 ltrs of Nepali Saufi Wine was seized. Learned counsel for the petitioner further submits that the seizure list was not prepared in accordance with the mandatory provisions of Section 100 Cr.P.C. The petitioner is in custody since 12.06.2019.
