====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR JHA ORAL ORDER 12-08-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. In the present case, the petitioner seeks bail in connection with Shri Krishnapuri P.S. Case No. 363 of 2024 , registered for the offences under Section 304 of the BNS.
3. As per the prosecution case, two miscreants on a motorcycle snatched the gold chain of the informant and fled away from the spot. The name of the petitioner transpired during investigation as one of the miscreants.
4. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The petitioner has been made accused on the basis of confessional statement of co-accused Amit Kumar as well as confessional statement of the petitioner
Patna High Court CR. MISC. No.51625 of 2025(2) dt.12-08-2025 2/3 himself. Apart from these statements, there is no cogent material against the petitioner to show his involvement. Nothing incriminating has been recovered from person or possession of this petitioner. The petitioner is in custody since 18.01.2025 but no Test Identification Parade has been carried out to establish his identity as the person who snatched the chain of the informant. The petitioner has been made accused in altogether 14 cases with similar allegation. The co-accused Amit Kumar has been granted by a Co-ordinate Bench vide order dated 20.06.2025 passed in Cr. Misc. No. 44719 of 2025. The case of the petitioner is on similar fitting. Charge sheet has been submitted.
5. Learned A.P.P. appearing for the State opposes the submission made on behalf of the petitioner. Learned A.P.P. submits that petitioner is a habitual offendor and is accused in a large number of cases of similar nature.

Having regard to the fact and circumstances and submission made on behalf of the parties and considering the period of custody of the petitioner and submission of charge sheet, the petitioner is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the
Patna High Court CR. MISC. No.51625 of 2025(2) dt.12-08-2025 3/3 satisfaction of learned Sub-Divisonal Judicial Magistrate, Patna/concerned court, in connection with Shri Krishnapuri P.S. Case No. 363 of 2024, subject to the condition laid down under Section 480(3) of the BNSS and other following conditions: (i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial court.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
