JUSTICE ARUN KUMAR ORAL ORDER 24-04-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Sessions Trial No. 244 of 2017 arising out of Kashim Bazar P.S.Case No. 153 of 2016 registered under Sections 302/34 and 120B of the Indian penal Code and 27 of the Arms Act.

Allegation in brief is that FIR named accused persons turned up on motorcycles and killed the informant's son by firing indiscriminately.

Submission is that petitioner is not named in the FIR and specific allegation of killing deceased is against FIR named accused persons and petitioner has been implicated merely on the basis of confessional statement of petitioner that he played role of informer regarding presence of the deceased at the place. Patna High Court Cr.Misc. No.24135 of 2018(2) dt.24-04-2018 2/2 allegation namely Shambhu Yadav and Kamal Yadav have been admitted to bail by co-ordinate Benches of this Court vide Cr. Misc. No. 22517 of 2017 and Cr. Misc. No. 23327 of 2017 respectively.

Having considered the aforesaid facts and circumstances, as the similarly situated other accused persons have been admitted to bail, the petitioner, namely , Manjeet Sah, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned ADJ-v, Munger in connection with S.Tr. No. 244 of 2017 arising out of Kashim Bazar P.S. Case No. 153 of 2016.
