JUSTICE RAJEEV RANJAN PRASAD ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date : 13-07-2018 Seeking exception to an order passed by the learned Writ Court on 17.05.2017 in C.W.J.C. No. 20574 of 2016, this appeal has been filed by the Union of India.

For vacating the quarter in question from the respondent employee who was transferred to Jammu & Kashmir and thereafter to North East Area, the reason for vacation was

Patna High Court LPA No.1560 of 2017 dt.13-07-2018 2/2 that he is retaining the quarter after his deployment out of the area but when the matter was agitated before the Writ Court, it was indicated that the quarter was vacated because of the misconduct committed by the employee and his son while retaining the quarter, inasmuch as, they fought and acted in an indisciplined manner with their neighbours.

The Learned Writ Court on examination of the facts found that the grounds now canvassed for vacation of the quarter did not form part of the allegations in the show-cause notice and interfered into the matter.

In doing so, no error has been committed by the Writ Court warranting reconsideration.

The Letters Patent Appeal stands dismissed.
