2. The petitioner has preferred this application for grant of regular bail in connection with Maker P.S. Case No. 48/2025 dated 08.03.2025 registered for the offences punishable u/ss 310 (4), 310(5) of the BNS and section 25(1-B)(a), 26 and 35 of the Arms Act.
3. As per the prosecution case, 3-4 unknown miscreants are alleged to have assembled for preparing to commit crime, in the meantime, police came there and two accused, Kanchan Kumar and Vikash Kumar (petitioner) were apprehended who disclosed the names of the other accused persons who fled away from there. On search, one loaded Katta, a mobile phone and Rs. 1100/- were recovered from the possession of the co-accused, Kanchan Kumar and one knife, one mobile phone and a motorcycle were recovered from the
Patna High Court CR. MISC. No.49111 of 2025(2) dt.13-10-2025 2/2 possession of the petitioner, Vikash Kumar.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The other co-accused person has already been granted bail by this court vide order dated 25.06.2025 passed in Cr. Misc. No. 37906/2025. The petitioner has three antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 08.03.2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Saran at Chapra in connection with Maker P.S. Case No. 48/2025.
7. The application stands allowed.
