JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 19-01-2018 At the outset learned counsel for the petitioner seeks permission to withdraw the Writ Application with liberty to avail the statutory remedy of appeal before the Board of Directors of the Bank.
In the Counter Affidavit, the respondents have taken a specific plea that the petitioner has moved this Court without exhausting the remedy of appeal.
The Writ Application is permitted to be withdrawn with the liberty aforesaid.
The Appellate Authority of the Bank shall consider the Memo of Appeal, if any, filed by the petitioner within a period of
Patna High Court CWJC No.4547 of 2011 (4) dt.19-01-2018 2/2 one month from today and shall dispose of the same by a reasoned order after providing opportunity of hearing to the petitioner in accordance with law.
It is made clear that the petitioner shall not be ousted on the ground of delay because he was prosecuting his remedy before this Court in good faith.
The reasoned order must be communicated to the petitioner within a period of four months from the date of filing of the appeal.
