JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-02-2015 Heard learned counsels for the petitioners and the State. Petitioners being the brothers, parents and brother-in-law of the husband of the informant, are apprehending arrest in a case registered for the offences punishable under Sections 498A and 34 of the Indian Penal Code and under Sections 3 and 4 of the Dowry Prohibition Act, 1961.
The basis accusation is of torture for non fulfillment of dowry demand.
Learned counsel for the petitioner submits that the husband of the informant has filed Matrimonial Case No.
Patna High Court Cr.Misc. No.36665 of 2014 (2) dt.10-02-2015 2/2 140/2014 in the court of Principal Judge, Family Court, Bhagalpur for restitution of conjugal rights.
Learned counsel for the petitioners submits that the petitioners have no concern with the informant and her husband. Considering the aforesaid facts, let the above named petitioners, be released on bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today in connection with Sajour P. S. Case No. 64 of 2014 on furnishing bail bond of Rs. 10,000/-( Ten thousand) each with two sureties of the like amount each to the satisfaction of learned sub Divisional Judicial Magistrate, Bhagalpur in Sajopur P.
