2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 303(2) with subsequently added Sections 317(2), (5) and 3(5) of the BNS, 2023, registered in connection with Chutiya P.S.Case No. 33 of 2025.

3. According to the FIR, some unknown thieves stole away the motor-cycle of the informant.

4. The learned counsel for the petitioner has submitted that the petitioner was not arrested at the spot. Nothing was recovered from his possession and his name has figured in the confessional statement of co-accused Chandeshwar Sharma. The confessional statement before the

Patna High Court CR. MISC. No.48855 of 2025(2) dt.11-08-2025 2/2 police has no evidentiary value, unless it is leading to recovery.

5. Considering the above facts and circumstances, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Civil Court, Dehri, Rohtas in connection with Chutiya P.S.Case No. 33 of 2025, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
